Acceptable Use Policy

In short: be honest, respect other people and their work, don't manipulate the market, and don't break the Services. If something breaks these rules, tell us at [email protected].

1. About this policy

1.1 This policy sets the rules for using mallow.art, operated by mallow labs L.L.C-FZ, and the mallow wallet, provided by mallow labs LLC (together, "mallow", "we", "us", "our"), including any content you publish (together, the "Services").

1.2 This policy forms part of the mallow.art terms and conditions (https://mallow.art/terms) and the mallow wallet terms of service (https://wallet.mallow.art/terms). If they conflict, the relevant terms prevail.

2. General conduct

2.1 When using the Services, you must not:

  • (a) break any law, including sanctions, anti-money laundering and consumer protection laws;
  • (b) scrape, harvest or systematically collect data or content, or use bots or other automated tools, except through our API in line with its terms;
  • (c) bypass, disable or interfere with security features, access restrictions or geographic restrictions, including by using a VPN to hide your location;
  • (d) upload or spread viruses, malware or anything designed to harm or monitor devices or systems;
  • (e) overload, disrupt or interfere with the Services or the networks they run on;
  • (f) impersonate any person, creator or brand, or misrepresent your identity or affiliation, including your affiliation with mallow;
  • (g) harass, threaten, abuse or intimidate other users or our team;
  • (h) phish for or try to obtain other users' seed phrases, private keys or account access;
  • (i) make false reports of abuse or infringement; or
  • (j) sell, rent or transfer your profile or username.

3. Market integrity

3.1 You must not manipulate, or attempt to manipulate, the marketplace or the price of any NFT, including through:

  • (a) wash trading, or any transaction that involves no real change in who owns an NFT;
  • (b) bidding on, making offers on or buying NFTs that you own or control;
  • (c) shill bidding, or coordinating with others to inflate or deflate prices or create the appearance of demand;
  • (d) creating a false or misleading appearance of trading activity or value; or
  • (e) trading on non-public information that you know could materially affect the value of an NFT.

3.2 You must not mint or list a single-edition (1/1) artwork that has been, or will be, minted as another token elsewhere.

4. Content standards

4.1 These standards apply to everything you publish on the Services, including artworks, metadata, Exclusive Content, profiles, Talkboard posts and comments ("Content").

4.2 By publishing Content, you confirm that you created it or have all the rights and permissions needed to publish it, including permission from any identifiable person shown in it.

4.3 Content must not:

  • (a) infringe anyone's copyright, trademark, privacy or publicity rights;
  • (b) contain or link to child sexual abuse material, or sexualize, exploit or endanger anyone under 18 in any way;
  • (c) contain non-consensual intimate imagery, or sexual content showing a real, identifiable person without their consent;
  • (d) promote terrorism or violent extremism, or threaten or incite violence against any person or group;
  • (e) harass, bully or humiliate anyone, or attack people based on race, ethnicity, nationality, religion, sex, gender, sexual orientation, disability or age;
  • (f) be defamatory, or knowingly false or misleading;
  • (g) be spam, unsolicited advertising, a pyramid scheme or a scam; or
  • (h) promote or facilitate illegal activity.

4.4 Mature content. You must mark mature artwork as NSFW when you mint or list it. Pornography and sexually explicit content are not allowed. Artwork marked NSFW is blurred by default, and users can choose to view it individually or turn the blur off in their settings.

4.5 We use automated tools to flag artwork that may be mature, and our team reviews flagged artwork and may mark it NSFW. We may remove artwork that is not permitted under this policy. If you repeatedly fail to mark mature artwork as NSFW, we may restrict your account.

5. Physical items

5.1 You must not use the Services to offer, sell or give away physical items that are illegal or unsafe, including weapons, firearms or ammunition, drugs or drug paraphernalia, tobacco or vaping products, stolen goods, or any item you do not own or control at the time of sale.

6. Reporting

6.1 To report Content or behavior that breaks this policy, use the report feature in the Services or email [email protected], telling us what it is, where it is and why you think it breaks this policy.

6.2 To report infringement of your intellectual property, follow the takedown process in section 9 of the mallow.art terms and conditions (https://mallow.art/terms).

6.3 We do not have to monitor the Services, but we may review Content and activity at any time. We decide whether something breaks this policy.

7. What happens if you break this policy

7.1 Depending on how serious the breach is and your history on the Services, we may warn you, hide or remove Content, delist NFTs from mallow's surfaces, cancel or hide listings, bids and offers, restrict features, or suspend or terminate your access. Where there is a risk to someone's safety or the law requires it, we may report the matter to the authorities.

7.2 Because NFTs and their metadata are recorded on public blockchains, removing them from the Services does not remove them from the blockchain.

8. Appeals

8.1 If you think we removed your Content or restricted your account by mistake, email [email protected] and we will review the decision. The Content may stay hidden while we review it.

9. Changes to this policy

9.1 We may update this policy from time to time. We will post the new version with an updated date.
